On March 2, 1993, the need <br />for additional water use analysis at the facility was discussed between <br />Minerals and Geology staff and Mr. Bob Leachman of the Service's Grand <br />Junction office. The addendum to the biological assessment concludes that an <br />average annual d etion of approximately 56.4 acre -feet will occur from the <br />Yampa River._ _1f?�. -ems - oa�- l a "- ....cJi d_edA.st- <br />FofmaT consultation (50 CFR 402.14) and conferencing (50 CFR 402.10) under <br />Section 7 of the Endangered Species Act were, therefore, initiated with <br />receipt of the supplemental information. Based on these conclusions, the <br />Service is providing this biological opinion and conference opinion for the <br />federally listed fish species and proposed critical habitat. <br />In accordance with Section 7 of the Endangered Species Act of 1973, as amended <br />(16 U.S.C. 1531 et seq.) and the Interagency Cooperation regulations <br />(50 CFR 402), this transmits the Service's biological opinion and conference <br />opinion for impacts to federally listed endangered species and proposed <br />critical habitat caused by the operation of the Hayden Gulch Loadout facility. <br />The Service recognizes the Office of Surface Mining as the lead Federal Agency <br />for this action; hence, the Service is providing this opinion to your office <br />rather than Minerals and Geology which has provided the biological assessment <br />and other supporting information.
