Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve an application <br />for permit renewal. <br />The application was submitted by GCC Energy, LLC for the King Coal Mine. This decision is <br />based on a finding that the operations will comply with all requirements of the Colorado State <br />Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34 -33 -101 et <br />seq., and the Regulations promulgated pursuant to the Act. If no request for a formal hearing is <br />made within thirty (30) days of the first publication of the issuance of this proposed decision, <br />then this decision becomes final. Upon submittal of acceptable surety by the applicant, the <br />permit will be issued. The permit application, all supporting documentation and any stipulations <br />or conditions will become a binding part of the permit. <br />No coal mining operations may be conducted on any Federal surface or coal until the Secretary <br />of the Interior has approved the proposed mining plan. <br />Permit No. C- 1981 -035 has no active stipulations. Since the last permit renewal, the applicant <br />has complied with the following stipulation, which was subsequently removed from the permit. <br />STIPULATION 17 <br />AS REQUIRED BY RULE 2.03.10, THE OPERATOR SHALL ADD TO THE LIST OF OTHER LICENSES AND <br />PERMITS IN THE PERMIT APPLICATION THE APPROVED WATER AUGMENTATION PLAN AND TRANSFER <br />OF WATER WELL RIGHTS THAT ARE IN PREPARATION IN RESPONSE TO THE MEMORANDUM THAT THE <br />DIVISION RECEIVED DURING THE REVIEW OF PERMIT RENEWAL 5 FROM THE OFFICE OF THE STATE <br />ENGINEER, DATED MARCH 12, 2007 <br />COMPLIANCE WITH STIPULATION 17 <br />MINOR REVISION NO. 37 (MR -37), WHICH INCORPORATED THE WATER DECREE AND <br />AUGMENTATION PLAN INTO THE PERMIT, WAS APPROVED BY THE DIVISION ON NOVEMBER 2, 2012. <br />2 <br />
