The letter was dated 26 February 2013 <br />and received at the Division's office on 28 February 2013. The Division is currently researching the issues you <br />identified and will notify you of its findings when we have completed our research. <br />In item 4 of the letter you have requested an informal conference regarding the Terror Creek Loadout's Permit <br />Renewal 06 and the issues you have raised. Pursuant to Rule 2.07.3(6)(a) "...any person who files objections or <br />comments... may request an informal conference." This request must be made within 30 days after the final <br />publication of the required legal notice. The last publication of the legal notice was 30 January 2013. The <br />request for an informal conference was received on 28 February 2013, which is within the required 30 -day window. <br />Therefore, the Division will schedule an informal conference in the locality of the mine as requested. <br />Pursuant to Rule 2.07.3(6)(b), "...the Division shall hold the informal conference within 60 days after the last <br />publication of the newspaper advertisement." Again, the last publication date was 30 January 2013. The informa <br />conference must be held no later than 1 April 2013 (by rule, since the 60th day is a Sunday the date rolls forward <br />to the next working day). Pursuant to Rule 2.07.3(6)(b)(ii) the Division must publish notice of the informal <br />conference "...in a newspaper of general circulation in the locality of the proposed mine at least two weeks prior <br />to the scheduled conference." Given that today is already 5 March 2013, the Division will need to schedule the <br />informal conference as close to 31 March 2013 as possible. The Division would like to know your availability the <br />week of 25 March 2013 (Jim Kiger of Terror Creek has notified me that he will be out of the office on 26 -27 March <br />2013).
