OBSERVATIONS <br />PERMIT #: M- 2001 -107 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: February 1, 2013 <br />The NCCI Pit #1 was inspected by Peter Hays and Tyler O'Donnell with the Division of Reclamation, Mining and <br />Safety (Division /DRMS) as part of the Division's monitoring inspection program. Mr. Chris Zadel with NCCI was <br />present during the inspection. The site was last inspected by the Division on April 10, 2012. <br />Financial Warranty: <br />The Division currently holds a financial warranty in the amount of $1,030,074.00, which appears adequate to <br />complete reclamation at the site based on the observations from this inspection. <br />Hydrologic Balance: <br />A substitute water supply plan is approved for the site by the Colorado Division of Water. The Operator is <br />allowed to expose 9.75 acres of water in multiple ponds and ditches, including process ponds, sedimentation <br />ponds, dewatering ditches and recharge ditches. The Operator has complied with the Division's requirement <br />for long -term groundwater augmentation by providing sufficient bond to clay line the pit. <br />Gen. Compliance With Mine Plan: <br />The site was active during the inspection. Sand and gravel extraction was occurring in Phase 11, located in the <br />southeast corner of the site. The excavation was approximately thirty (30) deep. The KPK gas well located in <br />Phase 5 has been abandoned according to the Operator. The well pipe was observed and is scheduled to be <br />cut off and removed soon. The south end of the site was being actively dewatered. The north end of the pit <br />was filling with water due to a recent pump failure. <br />Mining activities in Phase 11 are almost complete. Mining activity will move to Phases 8 and 9 in the <br />amendment portion of the site next. The Operator is aware of the requirement to post additional financial <br />warranty for the next phases prior to disturbing the area. <br />Sediment Control: <br />Two of the three sedimentation ponds were observed during the inspection. The Operator provided proof of <br />an approved wastewater discharge permit issued by the Colorado Division of Public Health and Environment in <br />2008. <br />Support Facilities On -site: <br />A processing plant was observed and was operational during the inspection. <br />Signs and Markers: <br />A mine sign and boundary markers were observed as required by Rule 3.1.12. <br />No problems were noted during the inspection.
