February 22, 2013 <br />Mr. Eric B. Fenster, Esquire <br />Completeness Review Determination: Complete — Application for Certificate of Designation, Henderson Inert Landfill, <br />Adams County, Colorado <br />Page 3 <br />(b) At the public hearing held pursuant to the provisions of this subsection (3), the governing body shall <br />hear any written or oral testimony presented by governmental entities and residents concerning such <br />proposed site or facility. All such testimony shall be considered by the governing body having jurisdiction <br />in making a decision concerning such application. For the purposes of this subsection (3), "residents" <br />means all individuals who reside within the geographic area controlled by the governing body having <br />jurisdiction or within three miles of the proposed site and facility or who own property which lies within <br />three miles of such proposed site and facility without regard to which county or municipality such <br />individuals reside within. <br />The following preliminary comments are provided to allow the Applicant to develop a response while the <br />Division is conducting its comprehensive technical review: <br />1. The Applicant is described variously as 1020 85 LLC, 120 85 LLC, and 120 -85 LLC. <br />Please clarify. <br />2. A note at the bottom of the cover sheet states that Jason Tarry, P.E., has prepared the Plan <br />(Tarry 2012), but the Plan (Tarry 2012) itself is not stamped and sealed by the responsible <br />professional engineer registered in the State of Colorado, in this case Mr. Tarry, which is not in <br />accordance with Section 3.2 of the Solid Waste Regulations. Within fourteen (14) calendar days <br />of the receipt of this letter, please provide a cover sheet that has been stamped and sealed by the <br />responsible professional engineer registered in the State of Colorado, which would be in accordance <br />with Section 3.2 of the Solid Waste Regulations. In addition, the exhibits are not stamped and <br />sealed by the responsible professional engineer registered in the State of Colorado. <br />3. The Vicinity Map referred to in Section 2 (Introduction and History of the Property) of the Plan <br />(Tarry 2012) is not included. Within fourteen (14) calendar days of the receipt of this letter, <br />please provide the Vicinity Map. <br />4. Section 2 of the Plan (Tarry 2012) states that total inert backfill of the remaining mine will be <br />placed to a final grade equal to that of 2 feet above the historical water table. Section 4.1 (Types of <br />Materials) of the Plan (Tarry 2012) states that asphalt materials— primarily consisting of hardened, <br />ripped -up chunks of road paving combined with the other inert materials —will be segregated and <br />set aside for placement only at a minimum of 1 foot above the maximum seasonally -high elevation <br />of the alluvial water table. Please revise Section 2 of the Plan (Tarry 2012) accordingly. <br />5. Section 3.3 (Property Ownership) of the Plan (Tarry 2012) states that (1) It is estimated that <br />approximately 100,000 cubic yards of material are necessary to fortify the slurry wall and avoid <br />further breach; and (2) These repairs are underway and are expected to continue throughout the <br />review phase of this Application. Please provide more information of the volume estimate and the <br />necessity to fortify the slurry wall and avoid further breach. <br />6. Section 6.4 (Run -On and Run -Off Control Measures) of the Plan (Tarry 2012) does not discuss <br />the kinds of specific information that are required in Sections 2.5.7 and 3.2.6 of the Solid Waste <br />Regulations. Please revise Section 6.4 the Plan (Tarry 2012) to discuss the required specific <br />information. <br />
