3607 County Rd. 65 <br />Rangely, CO 81648 <br />(970)675 -4300 <br />fax (970)675 -4399 <br />DESERADO MINE <br />BLUE MOUNTAIN ENERGY <br />February 25, 2013 <br />Mr. Zach Trujillo <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RE: Permit Revision #8 — Permit Area Expansion <br />Deserado Mine — Permit No. C- 1981 -018 <br />Dear Zach: <br />A permit revision adding an additional 1656.3 acres to BME's permit area is enclosed. No additional <br />surface disturbance is proposed as a part of this action. A list of permit changes is attached. <br />The revised mine plan undermines only one additional non -mine structure, Red Wash Reservoir No. 3, <br />and additional sections of Rio Blanco County Roads 65 and 73. Red Wash Res. #3 rarely sees any <br />runoff and is almost always dry. Deep cover overlies the portions of County Road 65 proposed to be <br />undermined and minimal effects are expected from subsidence. County Road 73 is an infrequently <br />traveled dirt road and should see minimal impact due to the road surface and depth of cover. <br />The only surface drainages new to the mine plan are ephemeral in nature and rarely see surface runoff. <br />The groundwater monitoring plan was reviewed and appears to appropriately address the additions <br />proposed. No known jurisdictional wetlands will be effected by the proposed activities. <br />Federal Coal Lease COC -74813 is pending and includes the area of the proposed changes.
