MANAGEMENT <br />RECEIVED <br />FEB 2 7 2013 <br />Division of RedStitin, <br />Mining & Safety <br />The Division of Reclamation, Mining and Safety (DRMS) issued a Notice of Violation <br />(NOV) to Bowie Resources, LLC (BRL) on January 9, 2013. On behalf of Bowie <br />Resources, the following information is provided: <br />Three steps were required in order for the NOV to be abated, <br />1) Provide all materials necessary to obtain approval for Technical Revision No. 76 to <br />authorize disturbance by February 12, 2013, <br />2) Post appropriate financial warranty for existing disturbance and any additional <br />proposed disturbance by February 12, 2013, <br />3) Save all topsoil in accordance with Rule 4.06.2 by February 27, 2013. <br />Step 1 was abated by DRMS approval of TR -76, on January 14, 2013. <br />Step 2 was abated by BRL posting the appropriate bond which was received by DRMS <br />on January 24, 2013. <br />Step 3 abatement has been performed. All visible topsoil in the overcast area, not <br />contaminated by road material was salvaged. Thirty -four haul trucks of topsoil, totaling <br />approximately 980 cubic yards, were salvaged and stockpiled in Topsoil Stockpile "E ". <br />
