The Division of Reclamation, Mining and Safety (DRMS) issued a Notice of Violation
(NOV) to Bowie Resources, LLC (BRL) on January 9, 2013. On behalf of Bowie
Resources, the following information is provided:
Three steps were required in order for the NOV to be abated,
1) Provide all materials necessary to obtain approval for Technical Revision No. 76 to
authorize disturbance by February 12, 2013,
2) Post appropriate financial warranty for existing disturbance and any additional
proposed disturbance by February 12, 2013,
3) Save all topsoil in accordance with Rule 4.06.2 by February 27, 2013.
Step 1 was abated by DRMS approval of TR -76, on January 14, 2013.
Step 2 was abated by BRL posting the appropriate bond which was received by DRMS
on January 24, 2013.
Step 3 abatement has been performed. All visible topsoil in the overcast area, not
contaminated by road material was salvaged. Thirty -four haul trucks of topsoil, totaling
approximately 980 cubic yards, were salvaged and stockpiled in Topsoil Stockpile "E ".
