Pineda <br />Director <br />The Division received Twentymile Coal's (TC's) application for a permit revision (PR -09) on <br />August 7, 2011. The application was determined to be complete on August 17, 2011. No <br />concerns have been received from other agencies regarding this proposed permit revision as of <br />the date of this letter. The Division received TC's adequacy responses in a letter dated February <br />15, 2013 and received on February 19, 2013. The Division has completed its secondary adequacy <br />review of the proposed permit revision based on the responses provided by TC. Please respond <br />to the following comments or concerns as necessary: <br />1. Division's Initial Comment: Based on a review of the ownership and control section of <br />the currently approved permit application package for the Foidel Creek Mine, comparing <br />the section with the current information in the Applicant violator System (AVS), there is <br />discrepancies that will need to be addressed by Twentymile Coal. Please address the <br />following discrepancies listed below.... <br />TC Response: An updated listing of officers and directors, which matches current <br />information in the Applicant Violator System, accompanies these responses for <br />replacement in Exhibit 47. This response is adequate. <br />2. Division Initial Comment: Based on the PR -9 application, TC is requesting an increase <br />of 560 permit area acres and 500 affected area acres in the Western Mining District. <br />Under the Western Mining District heading of approved page 2.01 -4, 3,620 is identified <br />as the amount of affected area added and 1,013 is identified as the amount of permit area <br />added due to the WMD. The PR -9 proposed page 2.01 -4 identifies 3,650 affected area <br />and 1,335 permit area. There appears to be a discrepancy in the total amounts of acreage <br />associated with the WMD.
