Canon National Bank commenced this action by filing its Complaint herein on or <br />about September 14, 2010. <br />2. Canon National Bank sold and assigned all of its right, title, and interest in and to the <br />loan and loan documents which are the basis for the Plaintiff's claims in this action to Byzantine <br />Quarry, LLC ( "Plaintiff" ). <br />3. Plaintiff and the Defendant US Bank, National Association ( "USB ") each hold deeds <br />of trust on the real property which is the subject of this action as identified in the Complaint (the <br />"Real Property"): <br />4. The Court has jurisdiction of all of the parties and the subject matter of this action. <br />5. The Defendant US Bank filed a stipulation regarding the Real Property. In the <br />stipulation, the Defendant US Bank acknowledges that Plaintiff's deed of trust as <br />identified in the Complaint is prior and superior to the lien of US Bank's deed of trust <br />(the "US Bank DOT ") on the Real Property. <br />
