permit application and technical revision no. 7.
• A revised reclamation cost estimate based on the AM -05 application
under separate cover.
Current Stipulations:
None.
The revision request needs to come via certified mail and meet the requirements of Rule 4.17.1
PERMIT #: M- 1977 -193
INSPECTOR'S INITIALS: TC1
INSPECTION DATE: February 7, 2013
is in process and will be provided
Recommendations:
The removal of the area on the south end from the permit boundary needs to be accomplished through separate
permitting revision: either an acreage release (AR), or a surety reduction (SR). The Division recommends
using an acreage reduction.
Upon receipt of the release request, the Division will then notify the landowners and the county; both of which
will have 15 days to submit written objections. As the area was inspected on February 7, the 60 -day time frame
for inspection doesn't apply. As long as there are no objections or no reclamation plans specific to that area •
that have not been met, the Division would be able to release that area from the permit within about three weeks
of receiving a release request. Please make sure there are no specific reclamation provisions in the approved
plan that have not been met.
In the mean time, T.H.E. could: 1) assume the area will be released, and not change the maps submitted for
AMO5 (note if for some reason the release is denied, the maps would have to be changed before approving the
AM); or 2) revise the AM -05 exhibits' maps and text referencing the removed south end area and change these
to reflect the existing condition.
If you decide to pursue Option 1, please also indicate on the release request that the current amendment
application assumes the release request will be approved and the submitted exhibits' maps and text
reflect that assumption, or something to that effect.
Also, please not the decision date for the current amendment application is April 15, 2013 as indicated on the
receipt letter mailed on January 14, 2013.
