(as provided in' the included plats, sheets 1 through 5). <br /> The intent of the developer is to excavate to grade the entire 310± acres under <br /> the approved P.U.D. , for purposes of meeting with the intent of the P.U.D. for <br /> residential development, as described there-in. Initially, a 5± acre parcel of <br /> land was selected for Iinitial grading in advance of a master grading plan for <br /> the area in order to avoid a potential delay in development activity, since a <br /> master grading plan will not be completed until approximately March 20, 1988. <br /> An area of high ground was selected since the area could be excavated without <br /> the potential of going below grade. <br /> Confusion arose when ithe excavator indicated in his approved county grading plan- <br /> that the activity wad for land leveling for agricultural purposes. Under suc''A- <br /> circumstances, a mining and reclamation permit would be required. .�_.Howevsr4:=as <br /> indicated by the approved P.U.D. , and in keeping with the histori` and <br /> business intent of my client, Michael B. Enterprises, Inc. , the intent of the <br /> activity is for,purposes of complying with the needs and intent of the <br /> appproved P.U.D. I <br /> We request as part of this letter, your signature below approving of our intent, <br /> to allow the approved five acre grading plan to proceed unimpeded. In turn, we <br /> will provide the CMLRD with an engineered grading plan prior to the March 1988 <br /> Board meeting.
