RE: Development activity located within the EZ; Sec. 3; T3S; R66W; 6th P.M.
Dear Ed:
The purpose of this letter is to clarify the nature of activity at the above
location, with the intent that development activity can proceed unimpeded via
removal of material to achieve grade in accordance with the terms of an approved
P.U.D. (as provided in' the included plats, sheets 1 through 5).
The intent of the developer is to excavate to grade the entire 310± acres under
the approved P.U.D. , for purposes of meeting with the intent of the P.U.D. for
residential development, as described there-in. Initially, a 5± acre parcel of
land was selected for Iinitial grading in advance of a master grading plan for
the area in order to avoid a potential delay in development activity, since a
master grading plan will not be completed until approximately March 20, 1988.
An area of high ground was selected since the area could be excavated without
the potential of going below grade.
Confusion arose when ithe excavator indicated in his approved county grading plan-
that the activity wad for land leveling for agricultural purposes. Under suc''A-
circumstances, a mining and reclamation permit would be required. .�_.Howevsr4:=as
indicated by the approved P.U.D. , and in keeping with the histori` and
business intent of my client, Michael B. Enterprises, Inc. , the intent of the
activity is for,purposes of complying with the needs and intent of the
appproved P.U.D. I
We request as part of this letter, your signature below approving of our intent,
to allow the approved five acre grading plan to proceed unimpeded. In turn, we
will provide the CMLRD with an engineered grading plan prior to the March 1988
Board meeting. Submittal of the grading plan for the entire 310± acres is intended
to lend support to the CMLRD as to our honest intent for the area in question.
