SANTA, Director <br /> March 11 , 1988 <br /> Bradford Janes, President <br /> Gambit, Inc. <br /> 1510 York Street, Su,i to 329 <br /> Denver, Colorado 80206 <br /> Re: Development activity located within Sec. 3, T35, R66W, Adams County <br /> Dear Mr. Janes: <br /> On Tuesday, March 8, 1988, we received your request for a determination <br /> of whether a mining and reclamation permit is required for the above <br /> mentioned activity operation. <br /> Your information indicated that Rocky Mountain Constructors intends to <br /> excavate approximately 2000 truckloads of borrow material from a a 5-acre <br /> field area and haul it, offsite to a construction site. Topsoil would be <br /> salvaged and then respread, and the area returned to dry land wheat <br /> farming. The site is located within an area which has received Adams <br /> County approval for both a Temporary Use Permit and Preliminary Planned <br /> Unit Development (P.U.D. ) You stated that* it seemed appropriate not to <br /> require a Mined Land Reclamation Division permit, as the area is within <br /> the P.U.D. and is part 'of the grading plan. <br /> According to the description you provided, we have determined that this <br /> operation is a mining operation as defined by 34-32-103(8) and is subject <br /> to the requirements of the Mined Land Reclamation Act C.R:S. 34-32-101 <br /> et seq 1973 as amended. Our determination is based upon the following <br /> inf—ormation: <br /> 1 . The excavated material meets the definition of "Mineral" as <br /> defined in 34i 32-103(7); <br /> 2. Restoration of the land to a beneficial use of dry land wheat <br /> farming is consistent with the definition of "reclamation" as . <br /> outlined in 34-32-1030 3) and does not appear to be consistent <br /> with the final, land use of a Planned Urban Development; and <br /> 423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
