STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY Department of Natural Resources 1313 Sherman St., Room 215 Denver, Colorado 80203 Phone: (303) 866-3567 FAX: (303) 832-8106
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
John W. Hickenlooper Governor Mike King Executive Director Loretta E. Pineda Director

Dear Mr. Thompson
The Division has completed its review of the 2012 Annual Reclamation Report (ARR) for the Golden
Eagle Mine, received on February 14, 2013. The Division finds the report in compliance with Rule 2.04.13.
The New Elk Mine is currently in Temporary Cessation, but is expected to resume production within a few months. A total of 162.98 acres have been disturbed, with 35.14 acres of the total phase I bond
released. No additional acres were disturbed and no additional reclamation occurred during 2012.
Considerable activity occurred at the site during 2012, but all projects were within the existing disturbance.

Bi-weekly inspections of the site were used to monitor noxious weeds and erosion damage of reclaimed areas.
No rills and gullies were identified.
Noxious weeds, including Canadian thistle and hounds-tongue, were controlled by hand-spraying the infested area with Tordon.
Sincerely,

Leigh Simmons Environmental Protection Specialist
Ron Thompson New Elk Coal Company, LLC
12250 Highway 12 Weston, CO 81091

February 14, 2013
Re: New Elk Mine, Permit C-1981-012
2012 Annual Reclamation Report Review
