Pineda Director <br />February 11, 2013 <br /> <br />Ron Thompson New Elk Coal Company, LLC <br />12250 Highway 12 <br />Weston, CO 81091 <br /> <br />Re: New Elk Mine (Permit No. C-1981-012) Minor Revision No. 119 (MR- 119) Designate new car park and material storage area west of main substation with fence, walkway and stairs to access entrance to main office & Bathhouse. <br /> <br />Dear Mr Thompson: We have received your application for a minor revision to your permit to conduct coal mining in <br />Colorado. Our initial review indicates that all preliminary items required by Rule 2.08.4(5) have <br />not been submitted. Thus, your application is incomplete for the purposes of filing as of February <br />11, 2013. In order for the application to be considered complete NECC should submit: <br /> <br />• A figure and cross section which shows the proposed graded topography, including the positions and dimensions of the guardrail fence, walkway and stairs (Rule 2.05.4(2)(c)). The cross section will allow the Division to assess the extent to which the reclamation bond <br />may need to be increased in order to ensure that the site can be reclaimed in accordance <br />with the agreed post-mining topography plan (Rules 3.02.2(2) and 3.02.2(6)); <br />• A description of what might typically be stored in the proposed Material Storage Area (Rules 2.05.3(2)(b), 2.05.3(3) and 4.04). <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise make <br />your application complete. <br /> <br />If you have any questions, please contact me. <br />Sincerely, <br /> <br /> <br />Leigh D.
