DIVISION OF RECLAMATION, MINING AND SAFETY <br />Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />Phone: (303) 866 -3567 <br />FAX: (303) 832 -8106 <br />STATE OF COLORADO <br />COLORADO <br />D IV IS I ON OF <br />RECLAMATION <br />MINING <br />SAFETY <br />RE: Roadside Portals (Permit No. C- 1981 -041) <br />Technical Revision No. 63 (TR -63) Adequacy Review <br />The Division of Reclamation Mining, and Safety (Division) has reviewed the above referenced <br />technical revision application submitted to incorporate a discussion of the flow variations in the <br />French drain system at the South Portal area and to provide a new design for the drainage ditch <br />H -H that crosses sediment Pond 9 (yet to be reclaimed in 2013). With former Technical <br />Revision No. 61 SCC was given approval for removal of Pond 9 and demonstrated that <br />associated disturbed areas will contribute fewer suspended solids to stream flow or runoff <br />outside the permit area than untreated drainage from the natural surrounding premising area. <br />This was accomplished by a soils loss comparison between disturbed locations and <br />corresponding non - disturbed reference areas using the Universal Soil Loss Equation. SCC has <br />also adequately demonstrated that the quality of untreated drainage from these disturbed areas <br />meets the State and Federal water quality standard requirements applicable after the <br />sedimentation pond is removed, for receiving streams. We have reviewed the TR -63 application <br />in its entirety and have no concerns with the new design for drainage ditch H -H that will cross <br />the reclaimed location of Pond 9 once it is removed. <br />However, during our review we noted that there were discrepancies in the permit application <br />package regarding the owners of record of surface and subsurface within and contiguous to the <br />permit area. This information was last updated in July 2011 with Technical Revision No. 62. <br />The Division has the following comments. <br />1. Please update Table 3 -1 in Volume 1, Tab 3 of the PAP to include Russell D.
