ffcEmE <br />Mr. Michael Cunningham <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Dear Mr. Cunningham: <br />February 15, 2013 <br />Via Certified Mail <br />Return Receipt Requested <br />7011 0470 0002 0359 4443 <br />Re: CEMEX Lyons Mine Permit M- 1977 -361 <br />,bequest for Extension of Technical Revision Submittal <br />RECEIVED <br />`FE 1 q 2013 <br />IVI510N OF RECLAMATI <br />MINI AND SAF <br />With this letter CEMEX Lyons would like to request an extension for the submission of an <br />updated Reclamation Plan as a technical revision to the Mining Permit # M1977 -361 for the <br />Sandstone Quarry, formerly the Silica Quarry. <br />As mentioned in your Inspection Report of December 17, 2012 for the inspection conducted on <br />November 30, 2012, CEMEX was required to submit by February 18, 2013. <br />CEMEX has some outstanding questions with regard to determining the most logical approach to <br />reclamation which has taken longer than expected to reach practical conclusions. By way of <br />answering some of these questions CEMEX Lyons has solicited and received two bids from <br />firms that have geotechnical engineering services. Additional assessments are being made with <br />regard to possibly converting from a 110 Permit to a 112 Permit. CEMEX Lyons is also working <br />with the corporate technical group to make decisions on how we should proceed. As CEMEX is <br />currently working through all the issues, it requires extra time to complete the process. <br />Moreover, once CEMEX secures a contractor to assist us with the different reclamation options, <br />we would like to schedule a meeting with you to go over our ideas and see if they will meet the <br />expectations of DRMS. <br />We would like to request an extension to April 30, 2013.
