Carr <br />Colorado Judicial Center <br />1300 Broadway, 10th Floor <br />Denver, Colorado 80203 <br />Phone (720) 508 -6000 <br />February 15, 2013 <br />Thanks for taking the time to speak with me this week regarding the current <br />proceedings for the now - expired Permit Number C -1981 -033, which the Division of <br />Reclamation, Mining, and Safety ( "Division ") issued to Bear Coal Company ( "Bear <br />Coal ") for the Bear Number 3 Mine. The Division issued Notice of Violation CV- <br />2012 -009 on December 17, 2012, and Cessation Order CO- 2013 -001 on January 14, <br />2013, to Bear Coal for failing to complete reclamation at and maintain a valid <br />permit for the Mine. <br />Because the Cessation Order requires the cessation of mining, Bear Coal has the <br />right to an informal hearing regarding the cessation of mining. I have enclosed a <br />copy of the Cessation Order for your reference. During our call you confirmed that <br />Bear Coal would waive the informal hearing pursuant to the Division's Coal Rule <br />5.03.2(6). If Bear Coal remains willing to waive the informal hearing as we <br />discussed, please sign and date below and send a copy of the signed letter to me via <br />email or U.S. Mail. <br />If Bear Coal is represented by counsel in this matter, please provide this <br />correspondence to its attorney and have him or her contact me regarding this <br />
