Applicant shall record a copy of this approval letter, a copy of the 55.2 acre area <br />monumented to be dried up, and a copy of the stock certificate for the 60 shares of Twin Lakes <br />Reservoir and Canal Company with the Fremont County Clerk and Recorder's Office. The 60 <br />shares of Twin Lakes dedicated to this plan may not be sold, leased or otherwise legally <br />encumbered during the term of this plan. <br />7. Adequate accounting of depletions and replacements (in acre-feet) must be provided to the <br />water commissioner (Brian.Suttorastate.co.us) and the division engineer <br />(Auomentation.Coordinator(state.co.us) on forms and at times acceptable to both of <br />them. The accounting form(s) shall be sufficient to demonstrate that the net effective <br />replacement equaled or exceeded the total depletion on a monthly basis. All replacement <br />water must be concurrent with depletions in quantity, timing and location, except that <br />releases aggregated at the discretion of the division engineer may occur in a later month <br />than the depletions. Said accounting must be received by the 10 of the month following <br />the reporting period. The proposed accounting form is provided in the attached Table 4. <br />8. For all sources of dry-up the following conditions apply related to fields containing alfalfa: <br />a. Credit from dry-up fields containing alfalfa will be assessed in the following manner: <br />1 <br />2 <br />3 <br />4 <br />For fields deep tilled or chemically treated to kill alfalfa, 100% credit will be <br />given for consumptive use as otherwise computed under the conditions of <br />this approval. <br />For fields not deep tilled or chemically treated to kill alfalfa, records of <br />monthly monitoring of depth to groundwater at existing irrigation wells or <br />existing or new monitoring wells or piezometers within 1 /4-mile of each alfalfa <br />field and capable of measuring ground water levels to a depth at least 8 feet <br />below the lowest point of elevation of the field must be maintained. The <br />wells or piezometers to be used must be identified and located by UTM <br />coordinates. <br />Credits will be reduced according to the following table when depth to groundwater <br />is less than the depth assumed to provide no significant contribution to alfalfa <br />growth. Measurements of depth to ground water shall be recorded on forms <br />acceptable to the Division Engineer and submitted to the Division Engineer's Office <br />by the 10 of each month.
