Dear Mr. Anderson:
The Colorado Division of Reclamation, Mining, and Safety (Division) is in the process of reviewing
outstanding Notices of Intents (NOI) on file that have expired, but remain open. As a part of this review,
the Division is updating the reclamation cost estimates associated with theses NOIs per Rule 3.02.2(4).
Western Fuels Colorado has three of these NOIs.
Regulatory requirements for final bond release include a submittal of drill hole abandonment reports for
holes drilled, a final reclamation report, a formal written request to the Division requesting for bond
release, and an on -site inspection of the reclaimed success of approved activities. The status and a
summary of the open NOIs are listed below.

A $4,544.00 bond is held for the project known as
Section 25, T47N, R16W in Montrose County. N o
November 30, 2011.
We ask you to consider the following:
New Horizon North Mine Water Well located in
reports have been received. This NOI expired
The exploration liability may be released pending submittal of a request for bond release and one
of the following:
a. If this well is a part of an operations or reclamation plan for an active mine permit and is
currently bonded under another bond instrument.
b. Transfer of well as per Rule 4.05.14 to the landowner.
c. Submitting a Drill Hole Abandonment and Final Reclamation Reports after the well are
sealed, plugged, and reclaimed.
2. If Western Fuels Colorado requests the above mentioned NOI to remain active:
a. Please submit a formal letter requesting the expiration to be extended to a date when all
activities will be completed, including the reclamation.
b. Per Rule 2.02.6(3)(a), please submit a report for each 180 -day period of coal exploration
activities.
