Our members and staff have an interest in the environmental health and <br />conditions of mined lands in Colorado and are directly and adversely affected by the JD -7 Mine, <br />located in western Montrose County. INFORM has longstanding concerns about the permitting <br />status of the JD -7, the environmental impacts associated with the mine, and its condition as an <br />idle, open pit that has never produced ore over the lifetime of its permit since being issued in <br />1977. <br />The JD -7 Mine is not in compliance with the Colorado Mined Land Reclamation Act. As the <br />Division reported following its most recent inspection of the site on Sept. 15, 2011: "The permit <br />history indicates no mining activities for this area have ever occurred." Cotter developed the <br />open pit, removed the overburden and established a large waste pile, and then placed the mine <br />into temporary cessation on April 7, 1981. Temporary cessation was renewed for a second, five - <br />year period on Aug. 21, 1986, and when that expired, the JD -7 was granted intermittent status on <br />Feb. 25, 1991. In Cotter's annual report filed on Dec. 12, 2012, the date of "last activity" at the <br />JD -7 was reported as 1982. <br />
