Fugate @state.co.us, loretta.pineda @state.co.us <br />Re: Objection to Notice of Temporary Cessation, Cotter Corporation LP -21 Mine, 112(d) Permit <br />No. M- 1977 -305 <br />The Information Network for Responsible Mining is a Colorado -based citizens organization that <br />advocates for the protection of communities and the environment and actively participates in <br />mining reviews. Our members and staff have an interest in the environmental health and <br />conditions of mined lands in Colorado and are directly and adversely affected by the LP -21 <br />Mine, located in western Montrose County. INFORM has longstanding concerns about the <br />permitting status of the LP -21 and the environmental issues related to its final reclamation status. <br />The LP -21 Mine is not in compliance with the Colorado Mined Land Reclamation Act. The mine <br />has been inactive for the past 33 years, since Cotter Corporation suspended mining operations in <br />1980 and placed the mine into its first five -year period of temporary cessation on Aug. 8, 1980. <br />Following a second, five -year period of temporary cessation, the LP -21 was reclassified as an <br />intermittent operation by the Division, even though the mine did not produce ore and operate on <br />an annual basis as required by the Act and Rules. Throughout the past 33 years of inactivity, <br />Cotter has not reported to the Division any production of ore. In fact, the mine is inoperable, and <br />the site was fully reclaimed and all reclamation work was completed in 2001, according to the <br />annual report Cotter filed with the Division on Feb. 21, 2012. <br />
