The level of this hole should be checked against the specifications of the riser(which are defined in <br /> exhibit 15 of the permit file). Three of the four culverts on the road to pond 9b are the responsibility of XTO. The <br /> culvert at the bottom of the down-drain is the responsibility of NECC; it was clear. <br /> Rock check dams above pond 6 had been cleaned out and straw bales had been restored (see photo 7). The gully to <br /> the side of the emergency spillway of pond 6 had been repaired with rocks and protected by bales (see photo 8). <br /> The pond embankment should be surveyed during the next quarterly pond inspection since it is not clear that the <br /> emergency spillway is the lowest point on the embankment. An erosive gully exists above the pond but is <br /> stabilized by rock armoring on lower section. <br /> Ponds 7 and 9a,and the drainages that report to them, were in compliance. <br /> GENERAL MINE PLAN COMPLANCE: <br /> As noted in a previous inspection report, identification of the important features at the Lorencito Canyon site is a <br /> difficult task, exacerbated by the lack of a complete map or maps. This problem is to be addressed during the <br /> permit renewal process. <br /> The map(s)must clearly identify all features,but in particular: <br /> • Roads and culverts that NECC is responsible for,and those that are maintained by third parties. <br /> • Ponds, as identified on the NPDES permit(what has been referred to as "pond 9"in the DRMS permit is <br /> apparently"pond 9b"in the NPDES permit) <br /> Until the permit renewal process is completed,map 1 from the 2008 Annual Reclamation Report will be used for <br /> reference. <br /> ROADS—Rule 4.03 <br /> Construction 4.03.1(3)/4.03.2(3),- Drainage 4.03.1(4)/4.03.2(4); Surfacing and Maintenance4.03.1(5)and <br /> (6)/4.03.2(5) and(6); Reclamation 4.03.l(7)/4.03.2(7): <br /> The roads around the mine site were all in good condition. <br /> RECLAMATION SUCCESS -Rule 4.15, Rule 3: <br /> Rills and gullies continue to need ongoing monitoring and repair around the site. Of particular note was a large <br /> gully on a north facing slope in the area between pond 8 and pond 9b,near the top of the drainage.
