Colorado <br />Revised Statute §37- 90- 137(11)(b) allows pre -81 exposed groundwater areas to be exempted <br />from augmentation requirements for the evaporation of groundwater. Per you letter, in order to <br />seek an exemption for pre -81 areas, Holcim is submitting the following documentation: <br />• An aerial photo taken in 1974 that shows the location of the pre -81 area. (Figure 2) <br />• A current aerial photo showing the claimed pre -81 area and mining permit boundary as it <br />existed at the time the at the time the groundwater was exposed. (Figure 1) <br />• A GIS compatible file that has a shape file for the pre -81 area and the permit boundary as <br />it existed at the time the ground water was exposed. (Enclosed CD ROM) <br />• A calculation of the area shown on the aerial photos. (Figure 1) <br />Please note that the map coordinate system is based on NAD 1983 State Plane Colorado North <br />FIPS 0501 Feet NAVD 88. <br />Figure 1 shows the current photography and the outline of the Permit Boundary as permitted <br />through the Department of Natural Resources, Division of Reclamation, Mining and Safety - <br />Permit #M- 1977 -348. Ponds 2 and C are on the Eastern side and are post 1981. The Ponds <br />being requested for exclusion per the Pre -81 statute are Ponds A, B, B2, and B3 which are <br />identified by coordinate on the West side of the Permit Boundary. The calculation indicating <br />approximate area is shown on the map. <br />Figure 2 shows the permit boundary and the pre -law (pre 1977 Reclamation Act) areas as well as <br />the ponds overlaid on the 1974 photo which shows the areas being mined prior to 1974. <br />
