Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Colorado Division of Reclamation, Mining and Safety (Division) received the above referenced <br />technical revision on January 18, 2013. The revision was called complete for review on January 23, <br />2013. There are several items that will need to be addressed prior to the Division's approval of the <br />technical revision, these items are discussed below: <br />1. The Operator requested the Division remove the 6.25 acre parcel from the permit area. The <br />Division can not release the liability for this parcel through the Technical Revision process. The <br />revised page no. 6 of Tab 22 needs to be updated. The second to last sentence of the third <br />paragraph of this page states that Seneca Coal Company "requested that the 6.25 acre area be <br />removed from the Yoast Mine permit area since the Yoast Mine no longer has control over the <br />land use of the area." This portion of the sentence implies this acreage was removed from the <br />permit area. It may be more appropriate to indicate that Seneca Coal Company intends to apply <br />for bond release of this parcel in the future or simply remove this portion of the sentence all <br />together to avoid confusion. <br />2. The proposed Exhibit 22 -3 submitted with the application needs to be revised to indicate the <br />boundary is not being changed, only the post mine land use. Please remove the "New Permit <br />Boundary" notation on this map. <br />3. Exhibit 3 -1 indicates Dennis A. and Laurie L. Hallenbeck own the surface of the 6.25 acres in <br />question. Based on the letter submitted by Routt County, it appears they have acquired 1.97 <br />acres within the 6.25 acres. The cover letter for the revision indicates Seneca Coal Company <br />does not own or control any of the land within this 6.25 acre parcel. For the remaining acreage <br />of this parcel not owned by Routt County, the Division will require Seneca Coal Company to <br />submit documentation that the Landowner is aware of the proposed land use change and is in <br />agreement with this revision. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
