Colorado Department of Public Health and Environment
Water Quality Division
Permits & Enforcement Section
4300 Cherry Creek Drive South
Denver, Colorado 80246 — 1530
February 4, 2013
RE: December 2012 Discharge Monitoring Reports
New Horizon Mine, Permit No. CO- 0000213
WET test reporting for Outfall 007X, 011X and 013X
ATTN: Ms. Kelly Morgan
Enclosed are the Western Fuels - Colorado, New Horizon Mine Discharge Monitoring
Reports (DMR) for Whole Effluent Toxicity (WET) testing on Outfalls 007, 011 and 013.
As noted in our submittal on January 25, 2013, the Division found a problem with the
Division - issued DMRs for reporting WET results for Outfalls 007, 011 and 013. The
Division recently provided updated DMRs for WET reporting and provided an extension
to the due date for these DMRs (enclosed email correspondence). The corrected DMR
forms were used for this reporting for Outfalls 007, 011 and 013.
As noted in the January submittal, following accelerated testing New Horizon
demonstrated that there is "no pattern of toxicity" for Ceriodaphnia dubia (reproduction)
for Outfall 013. Therefore, the facility has returned to the regular monitoring schedule.
If you have any questions or comments please contact me at 970.864.7590, email
tfry(awfcnucia.org or Chantell Johnson, Tri -State G &T, 303.254.3185, email
cjohnson(atristategt.orq.
Sincerely,
Thomas D.
