Colorado Department of Public Health and Environment <br />Water Quality Division <br />Permits & Enforcement Section <br />4300 Cherry Creek Drive South <br />Denver, Colorado 80246 — 1530 <br />February 4, 2013 <br />RE: December 2012 Discharge Monitoring Reports <br />New Horizon Mine, Permit No. CO- 0000213 <br />WET test reporting for Outfall 007X, 011X and 013X <br />ATTN: Ms. Kelly Morgan <br />Enclosed are the Western Fuels - Colorado, New Horizon Mine Discharge Monitoring <br />Reports (DMR) for Whole Effluent Toxicity (WET) testing on Outfalls 007, 011 and 013. <br />As noted in our submittal on January 25, 2013, the Division found a problem with the <br />Division - issued DMRs for reporting WET results for Outfalls 007, 011 and 013. The <br />Division recently provided updated DMRs for WET reporting and provided an extension <br />to the due date for these DMRs (enclosed email correspondence). The corrected DMR <br />forms were used for this reporting for Outfalls 007, 011 and 013. <br />As noted in the January submittal, following accelerated testing New Horizon <br />demonstrated that there is "no pattern of toxicity" for Ceriodaphnia dubia (reproduction) <br />for Outfall 013.
