Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed and found <br />the above referenced report to generally be in compliance with Division regulations, namely <br />Rule 2.04.13. <br />However, in the form on the second page of the ARR submittal (between the cover sheet and the <br />first page of the letter report), there is an apparent error. In the listing of total number of acres, <br />the value 401.4 acres is reported; based on Division records this value is accurate. For Phase 11 <br />released acreage, the value of 394.5 acres is listed; this value appears to be inaccurate. The <br />difference between these values (401.4 less 394.5) is 6.9 acres, but we believe the difference (the <br />number of acres that have not been Phase II released at the Loadout) should be 4.8 acres, which <br />is the area encompassing the access road and the reclaimed pond. Therefore, the value of Phase <br />II released acres should be 396.6 (401.4 less 4.8) rather than 394.5. Note that the value of 6.9 <br />acres is the amount of area at the Loadout that has been Phase 11 released (through SL -04) rather <br />than the amount that has not been Phase II released. <br />Please re- submit the form with a corrected value for Phase II released acres.
