February 1, 2013 <br />Mr. Eric Jacobs <br />Colorado Department of Public Health and Environment <br />Hazardous Materials and Waste Management Division <br />HMWMD -HS -B2 <br />4300 Cherry Creek Drive South <br />Denver, Colorado 80246 -1530 <br />RE: Approval with Conditions: Climax Mine Crusher Adit Vent Raise Asbestos Disposal Shaft <br />Closure Plan <br />Dear Mr. Jacobs, <br />Climax has reviewed the conditional approval of the Closure Plan for the Climax Mine Crusher Adit Vent <br />Raise Asbestos Shaft submitted to the Hazardous Materials and Waste Management Division (HMWMD) on <br />November 16, 2012. The conditional approval was issued by the HMWMD on January 8, 2013. The <br />conditions cited in the approval are agreeable to Climax with the exception of Condition 1 which requires that <br />all closure activities be completed no later than September 1, 2013. <br />As we have recently discussed Climax plans to make a good faith effort at completing the closure this year. <br />However, given the 11,400 foot site elevation and significant winter snowfall, it's likely that Climax will not be <br />able to gain access to the site until sometime late spring or early summer. Access will also need to be <br />improved such that the proper asbestos abatement and construction equipment can be safely mobilized to the <br />site. Taking these factors into consideration, a September 1, 2013 deadline for completion of the closure is a <br />relatively narrow window for completing this work. Given these circumstances, Climax respectfully requests <br />that the deadline for completion of all closure activities be changed to September 1, 2014. This extended <br />deadline will allow for flexibility in completing this project should it be needed due to unforeseen <br />circumstances. <br />Thank you in advance for consideration of this proposal.
