Mr. Lockard <br />Page 17 <br />February 1, 2013 <br />6.4.19 Exhibit S — Permanent Man -made Structures <br />29. The Applicant provided a structure agreement for the powerlines and poles which are located <br />along Highway 34; the structure agreement was dated July 7, 2008. Please provide the <br />Division with an updated agreement with Y -W Electrical Association, Inc. that is signed and <br />dated during the current year. <br />30. The Applicant has identified Highway 34 and the Burlington Northern Railroad as structures <br />that are within 200 feet of the affected area. The Applicant will need to submit the <br />appropriate structure agreements for these structures as required by Rule 6.4.19. If an <br />agreement with the structure owners cannot be reached, then the Applicant shall provide an <br />appropriate engineering analysis that demonstrates that such structures shall not be damaged <br />by activities occurring at the mining operation. <br />31. During the inspection conducted on January 24, 2013, the Division observed a barbed wire <br />fence located on the north side of the amended area. Please identify the owner of this <br />structure and label this structure on the Mining Plan Map. In addition, the Applicant will <br />need to provide a structure agreement with the owner of the fence. <br />This concludes the Division's preliminary adequacy review of this application. Please remember <br />that the decision date for this application is March 12, 2013. As previously mentioned, if you are <br />unable to provide satisfactory responses to any inadequacies prior to this date, it will be your <br />responsibility to request an extension of time to allow for continued review of this <br />application.
