January 24, 2013
Timothy A. Cazier
Environmental Projection Specialist
Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, Colorado 80203
Re: Notice of 112 Construction Materials Reclamation Permit Amendment Application Consideration Tezak
Heavy Equipment Co., Inc. T.H.E. Aggregate Source, Permit No. M- 1977 -193 (CHS #32660) A - 0 S
Dear Mr. Lazier:
Thank you for your correspondence dated January 15, 2013 (received by our office on January 22, 2013)
regarding the subject project.
A search of the Colorado Cultural Resource Inventory database indicates that no cultural resource inventories
have taken place within the expanded permit area and no historic properties have been recorded therein.
However, our files contain incomplete information for this area, as most of Colorado has not yet been
inventoried for cultural resources. As a result, there is the possibility that as yet unidentified cultural resources
exist within the proposed permit area.
Please note that as there is federal agency involvement in this project — the project area is partially located on
lands managed by the Bureau of Land Management Royal Gorge Field Office — it is the responsibility of the
federal agency to meet the requirements of Section 106 of the National Historic Preservation Act as set forth
in 36 CFR Part 800 ( "Protection of Historic Properties "). Compliance with this Act includes the
identification of historic properties (i.e., cultural resources which are eligible for or are listed in the National
Register of Historic Places) located within the area of potential effects and determining whether the
undertaking or project activites will have an effect upon such properties. The State Historic Preservation
Office, Native American tribes, representatives of local governments, and applicants for Federal permits,
licenses or other approval are entitled to consultative roles in this process.
Thank you for the opportunity to comment. If we may be of further assistance, please contact Mark Tobias,
Section 106 Compliance Manager, at (303) 866 -4674 or mark.tobias @state.co.us.
Sincerely,
ai
.gEdward C.
