3,016 acres within the permit boundary at the Roadside North and South Portals Mine. The purpose of this Bond <br />Release Request was to release those lands within the permit boundary located at the Unit Train Loadout, <br />Permanent Flood Control Dike, Railroad Spur and Overland Conveyor lying north of I -9/10 Road and having a <br />designation of Industrial as the postmining land use. The 75.2 acres have been fully reclaimed and an Industrial <br />land use has been implemented. <br />Permit Renewal No. 6 Review Process <br />On April 3, 2012 the Division notified MCM that mining and reclamation permit C -81 -041 for the Roadside <br />Portals would expire on January 3, 2013. The Division requested pursuant to Rule 2.08.5, that a renewal <br />application be received in the Division office on or before July 7, 2012. SCC's application for Successive <br />Renewal No. 6 (RN -6) of Permit C- 1981 -041 was received by the Division on July 2, 2012. The application <br />included a renewed certificate of insurance, in addition to the required application form and proposed newspaper <br />public notice. The application was deemed complete on July 11, 2012, and notices were provided to various <br />local, state, and federal agencies on that date. Public Notice of the application was published in the Grand <br />Junction Daily Sentinel once a week for four consecutive weeks, beginning July 23, 2012. Copies of the <br />application were filed with the Mesa County Clerk and Recorder's Office, and at the Denver and Grand Junction <br />offices of the Division. Written comments were received during the review period from Colorado perks and <br />Wildlife, and the State Historic Preservation Office (SHPO). Colorado Parks and Wildlife and SHPO letters <br />indicated no concerns or objections with the renewal application. <br />The Division's preliminary adequacy review letter was sent to SCC on September 10, 2012. SCC responded with <br />a submittal package dated November 12, 2012 in which SCC fully addressed all adequacy concerns identified in <br />the Division's preliminary review. The Division conducted Applicant/Violator System (AVS) queries on <br />08/15/12, 11/15/12, and on 01/30/13 and found that there were no violations listed. Several discrepancies <br />between the permit application package and the AVS were noted on 08/15/12 and on 01/30/13 and these have <br />been corrected as part of the adequacy review process. <br />The reclamation cost estimate for the Roadside Portals was last revaluated and updated with PR -5 in May 2012. <br />PR -5 resulted in a liability decrease from $1,005,256.00 to $805,952.60, a decrease of $199,303.40 primarily <br />due to changes to the reclamation plan and decreased revegetation costs. There have been no changes to the costs <br />in CIRCES and there have been no revisions to the permit application package since the cost estimate was last <br />completed in May 2012. Hence, the Division did not reevaluate the bond liability for Permit Renewal No. 6. The <br />Division currently holds a surety bond in the amount of $805,952.60 which is equal to the calculated liability <br />amount. <br />The Applicant/Violator System was queried again on 01/31/13. The Division recommends approval for the <br />permit renewal. The proposed decision to approve the renewal was issued on February 1, 2013. <br />
