New Elk Mine C1981012 MT6 updates 4 January 18, 2013 <br />Slope Conveyor Drive Building and thickener tank math errors have been corrected. Map 11: 50'1 x <br />37.5'w x 15'h (est.)= 28,125 cf. <br />The Division concurs that 2 of the river crossings are permanent. The Division adjusted this line to <br />show removal on one metal walk bridge located at the permanent concrete dam in the Purgatoire <br />River. <br />Rock dust bin math error has been corrected. <br />Slope heater removal. This line has been corrected to reflect 2 approved heaters. <br />The Division recalculated the cost for powerline removal using single pole. NECC noted concerns <br />regarding the length calculated by DRMS. The Division re- measured the length of permit area <br />powerlines using map 11 -Sheet 2, and Map 12. Lines noted as 'San Isabel' were not included. <br />DRMS did not add buried line in the overall powerline calculation. Only powerlines shown on the <br />two referenced maps that service mine facilities and operations were included in the calculation. <br />Dry ice for tank cleaning was recalculated to reflect 1.5 Ibs /100 gal. <br />Culvert #57 and #58 were previously approved for bond release during SL2, and have been <br />removed from Task 095. Culvert #C23 and #C16 are permanent. Costs for removal of these two <br />culverts have been eliminated. <br />Refuse belt extension and grasshopper conveyor. The Division concurs that these two conveyors <br />were approved for bond release during 5L2. Additional conveyors have been permitted since SL2 <br />and included as separate line items. <br />Jansen loadout: the volume of concrete for footers has been corrected, cost for removal of Jansen <br />loadout powerlines has been removed as they are owned by a third party. <br />Line items from Task 95B, and 136 have been incorporated into Task 095. Task 95B and Task 136 <br />have been eliminated. Task 95C includes items approved during MR 112. These line items are not <br />found in Task 095, hence Task 95C is still a valid demolition task for Midterm No. 6. Line items <br />previously found on Task 95F have been incorporated into Task 095. <br />NECC states that a cost for underground refuse disposal is unexplained and unnecessary. This line <br />was poorly described in the Division's estimate. These costs are a result of approval of MR95 and <br />MR104. These have been described as line items; removal of 9000 ft. of surface HPDE pipe, and <br />removal of piping at the two slurry holes. Sealing of the approved slurry wells is included in <br />borehole sealing. <br />Railroad ballast removal costs in the East portal have been removed. The rail line and associated <br />structures are owned by a third party and not NECC's reclamation liability. <br />NECC contends that inclusion of a cost for removal and disposal of 300CY of contaminated soil is <br />extreme. Further investigation into this item found that the Division approved bond release for <br />
