New Elk Mine C1981012 MT6 updates 2 January 18, 2013 <br />the entire RDA up to 8000 feet elevation. Therefore, the Division is required to include tasks for the final <br />configuration of the RDA. <br />#6: During the December 20, 2012 meeting with KAG, the area used to calculate Task 27 was questioned. <br />KAG noted that only areas without refuse (DNR) would be ripped. The Division evaluated Map 16 and <br />subsequent Map 12 for DWDA #3 footprint exclusion, by digitizing the area encompassed as DNR. Permit <br />page 2.05 -47 commits to ripping of disturbed areas, "Areas will be ripped to a depth of 18 inches prior to <br />topsoil distribution and harrowing or chiseling prior to seeding." The Division understands this permit <br />commitment to mean that areas that will receive 4 -6 inches of topsoil (DR areas) will be ripped prior to <br />topsoil lay down. These areas shown on Maps 15 and 16. The Division digitized a total of 18.1 acres that <br />would require ripping and no topsoil replacement, and 6.82 acres that would be ripped prior to topsoil lay <br />down (DR areas). Task 27 has been updated to reflect a total area of 24.92 acres. The Division concurs that <br />Development waste piles (DWP, DWDA #2, and DWDA #3) would not be ripped. <br />#7: Permit page 2.05 -22 and 2.05 -47 state that disturbed areas will be ripped prior to seeding. Areas <br />shown on Map 15 and 16 that were identified as containing refuse material would be ripped prior to being <br />covered with 4 -6 inches of topsoil. These areas are designated DR on Maps 15 and 16. Areas designated as <br />"Disturbed No Refuse" (DNR) would be ripped to 18 inches prior to harrowing or chiseling and seeding. <br />#8: Please see the response to item #7 above. <br />#9: The Division concurs with NECC comment that site wide finish grading would not be required. Grading <br />of the disturbed east portal area in already included in Task 001. Tasks 037 and 038 have been eliminated. <br />#10: The Division concurs that Containment Area #2 at the West Portal is permanent, Map 16. Tasks 049 <br />and 050 have been eliminated. <br />#11: The Division concurs that ditches at the RDA are permanent, or will be covered with waste as the <br />height of the pile progresses. Task 052 has been eliminated. <br />#12: Task 065 has been eliminated as the Southwest coal stockpile is no longer in existence. This area is <br />covered by other reclamation tasks <br />#13: The Division concurs that the area included in Task 066, Mine Rescue Training Area was re- disturbed <br />during the highway widening project. Acceleration /deceleration lanes were constructed, regraded and <br />seeded during the highway project. As such, it would be unlikely that CDOT would remove these lanes <br />post- mining. This configuration should be considered permanent and will not require regrading. Task 066 <br />has been eliminated. <br />#14: Task 067 has been eliminated by the CDOT lane expansion project on State Highway 12 as per item <br />#13. <br />#15: The Division concurs that Task 075 would be unnecessary. Task 075 has been eliminated. <br />
