<br />Twentymile Coal, LLC (TC) has filed an appli-
<br />cation with the Colorado Division of Recla-
<br />mation, Mining, and Safety (CDRMS) for par-
<br />tial release (Phase 1 Bond Release) of recla-
<br />mation habit for several areas of the Foidel
<br />Creek Mine (Mine), encompassing approxi-
<br />mately 143 acres. These facilities and
<br />areas, which uncWde the CYCC Office Build-
<br />ing, Eastern Mining District (EMD) /9 -Right
<br />Ventilation Shaft Installation 18 -Right Intake
<br />Shaft Installation, and Fish Creek Tipple Fa-
<br />cdrtres and an associated sod mate' at stock-
<br />pile located near the Middle Creek (Pit 3)
<br />Shop, are no longer needed to support on-
<br />going or future operations, and have there-
<br />fore been reclaimed. TC is the current
<br />owner, operator, and perrnittee under Permit
<br />No C -82 -056 (originally issued May 23,
<br />1983) for the Mine and related support facili-
<br />ties. The Mine is located approximately
<br />twenty miles southwest of Steamboat
<br />Springs, Colorado near the intersection of

<br />The CYCC Office was constructed in 1967,
<br />and demolshed in 2006 The EMD✓9 -Right
<br />Ventilation Shaft Installation was permitted
<br />(TR95 -24) and constructed in 1996 to pro-
<br />vide adequate mine ventilation an flow tor on-
<br />going operations in the Eastern and Northern
<br />Mining Distracts With completion of active
<br />mining in these areas, the associated facili-
<br />ties and area were reclaimed in 20W-20 10.
<br />The 18 -RrgM Intake Shaft Installation was
<br />permitted (TR04 -44) and constructed to pro-
<br />vide adequate mine ventilation airflow for on-
<br />going operations in the Northern Mining Dis-
<br />trict. Subsequent additions included installa-
<br />tion of an escape hoist in 2005 (MR05 -200),
<br />shaft heaters in 2007 (MR07 -715), and Mine

<br />The Fish Creek Tipple Facilites were con-
<br />structed in 1974 to receive, handle, and load
<br />coal to rail torn the Energy Fuels No 3 Mule
<br />and other Energy Fuels surface mining oper-
<br />ations which were active at the time The fa-
<br />cility remained in use through about 1980.
<br />As applicable regulations were promulgated,
<br />this facility was re- peunntted by Cyprus
<br />Yampa Valley Coal Company in 1984. in an-
<br />ticipation of possible use in conjunction with
<br />a nearby underground test mime. The Facility
<br />has remained idle since about 1980, and was
<br />reclaimed during the period 2011-2012
<br />The CDRMS currently holds a Self -Bond in
<br />the amount of $10,056,089. The requested
<br />partial liability release, in the amount of
<br />$312,891, addresses release of TC from any
<br />fun her liability for the facilities demolition and
<br />removal, shaft sealing, backfrling, grading.
<br />and drainage contrd activities that have
<br />been completed for the subject reclaimed
<br />areas TC will retain liability for effective
<br />drainage control and revegetat ion of the sub-
<br />ject areas, until such trine as applicable re-
<br />vegetatio❑ success standards are achieved.
