Since backfilling is complete and released for <br /> the main area of the yard, the cost re-estimate assumes that river channel cut will be backfilled into the <br /> 7-Shaft area. The DMG's cost re-estimate indicates that the reduction in bond amount requested in the <br /> SR-03 application based on a percentage completion of the Storke Yard backfilling and grading would <br /> create a funding shortfall for the river channel reconstruction project, and that re-estimated reclamation <br /> costs based on current conditions are the appropriate basis for determination of the bond amount. <br /> 2. E-Dump <br /> The DMG, through approval of Revision SR-03 releases CMC from reclamation liability for grading the <br /> west side of E-Dump. The costs associated with reclamation task#25 from the DMG's original 1998 <br /> estimate and in the year 2001 re-estimate have been eliminated from the amount of required bond. <br /> Reclamation costs for tasks 28 and 29, to place and spread topsoil on top of E-Dump are included in the <br /> year 2001 re-estimate even though extensive topsoil placement above and beyond reclamation permit <br /> requirements has already occurred on the dump's west side. The E-Dump topsoiling cost is not deleted <br /> from the amount of required bond because the topsoil that this cost applies to remains in stockpile, and <br /> if it is not spread on E-Dump it will be used to enhance revegetation potential elsewhere on the affected <br /> land. Removing the cost dedicated to tasks 28 and 29 from the bond could compromise the assurance <br /> that all of the topsoil stockpiled for reclamation at Climax could be put to beneficial use. Limitations to <br /> the release of reclamation responsibility for the west side of E-Dump are as follows: <br /> • Topsoiling requirement remains in place as discussed above. <br /> • ran-going maintenance of storm water controls, repair of rills and gullies, and improvements to <br /> manage potentially acidic seepage may be required on E-Dump (see 9/26/00 and 8/30/99 inspection <br /> reports). <br /> • Revegetation responsibility release was not requested by CMC and is not included. <br /> 3. No. 3-Dam <br /> The DMG, through approval of Revision SR-03 releases CMC from reclamation liability for grading <br /> and capping No. 3-Dam. The costs associated with reclamation tasks 54, 55, 56, 57, 58, and 64 from <br /> the DMG's original 1998 estimate and in the year 2001 re-estimate have been eliminated from the <br /> amount of required bond. Limitations to the release of reclamation responsibility for the 3-Dam <br /> capping project are as follows: <br /> • On-going maintenance of storm water controls and repair of rills and gullies may be required on 3- <br /> Dam (see 9/26/00 inspection report). <br /> • Revegetation responsibility release was not requested by CMC and is not included. <br /> • Area C-19 illustrated on the permit amendment AM-02 map is not released (see 9/26/00 inspection <br /> report). <br />
