The road that forks southwest off the <br />Monarch Fan Road is not and was not a non - mining road. Energy Fuels used this road to access the main <br />electrical disconnects and electrical meter that were located along this road about a half mile from the <br />intersection. In fact, Energy has never removed the switch gear from the meter power pole although parts have <br />fallen off the pole. Prior to when the electric meter was removed the power company vehicle used the road <br />monthly to read the meter; the power line and meter were used for no other <br />electric power except the Monarch Fan. This road was certainly used by Energy as an access road as the <br />Monarch Fan could not have functioned without it. On at least one occasion Energy graded this road in order to <br />permit vehicle travel. Historically, about 25 years ago this road was only a two track path. Erosion and grading <br />has resulted in the road depression. About three years ago The Corley Co. was going to start a reclamation <br />program to limit further damage. This would have closed off the road to vehicular travel. At that time George <br />Patterson informed us that Energy needed the road for access.
