JoEllen Turner <br />970 - 864 -7682 p.5 <br />any more than their property to be returned to the Condition that it was prior to mining and to the Uses <br />or higher uses as the LAW requires. This is part of the ACT and the Rules and Regulations under the Act. <br />Pr -07 that has been currently submitted, and again, is against all rules and regulations, the ACT, and a <br />CURRENT BOARD ORDER of November 2010, that the miners attended. The Board Order of PR -06 was <br />bragged on in the Nucla Forum, their victory, as well as this is what they have been operating under for <br />over 2 years now. This Order requires WFC to return all the Morgan property back to the Prime <br />farmland status that it was prior to mining and documented by NRCS over a 40 year period.(NRCS is the <br />only authority to decide prime farmland status.) <br />Pr-07 states that the CCC ditch, and I quote, is an" INEFFICIENT" water supply. It also states that it <br />requires 70 shares of water to do 22.89 acres. (It takes one share to do 2 acres of ground.) It also states <br />that the Morgan property was Pinion, Junipers, and sage brush prior to mining, and WFC had no <br />knowledge of any one, including James Johnson and the Lloyd properties of have having any type of <br />gated pipe or furrows. Pr - 07 also wants to return the Morgan property to non -prime farmland. If you <br />can assist in any way as to writing letters objecting to PR -07 which violates all rules and regulations and <br />filled with numerous discrepancies, please do so. New Horizon North has a separate permit and this 350 <br />page document of Pr-07 is to hurt the Morgans, or to bankrupt them, refusing to acknowledge a court <br />order, a Boards Order and an OSM order as well as DRMS. <br />We at no time are requesting that the mine be shut down. We only want the law enforced on our <br />property and our property be returned to us "AS GOOD AS OR BETTER THAN IT WAS" prior to mining. <br />Pr -07 wants to return this property to flood irrigating, which the Morgans have not done for 39 years. <br />The livestock was sold in 1987 and this has been a" CASH ONLY" FARM SINCE THAT TIME. <br />The State can be contacted at: Attention David Berry Division of Reclamation, Mining, and Safety <br />1313 Sherman Street Room 215 Denver Colorado 80203. This revision takes all the progess that we <br />have had for 5 years and all the decisions regarding this property throws it down the drain. Pr -07 is <br />where Patty Morgan used to live known as the "Sunshine Corner" where the Alfalfa fields and corn fields <br />use to be. Many properties such as James Johnsons, properties that had always been historically used <br />and cropped, is being returned to DRYLAND. All against rules and regulations. Historically used as <br />cropland(1.04) is any 5 out of a 10 year period.
