ENFORCEMENT ACTIONS/COMPLIANCE
On August 8, 2012,the Division directed Energy Fuels to remove the blockage from monitoring well
MW-NW. Energy Fuels documented that they removed a tangle of steel cable from MW-NW on August
27, 2012. The Division documented the condition of MW-NW on September 17,2012 using a borehole
camera. The Division observed a block of wood in the well at 353 ft.below the top of the casing. The
Division sent another letter to Energy Fuels on November 28, 2012 directing Energy Fuels to clear the
obstruction from MW-NW prior to the end of 2012 (December 31, 2012), and provide documentation to
the Division that this had been accomplished. On December 31,2012 Energy Fuels submitted an
application for a technical revision requesting the elevation of MW-NW monitoring point to coincide with
the elevation of the obstruction. Energy Fuels provided no evidence that the obstruction had been cleared
from MW-NW.
Observation with the borehole camera on January 23,2013, confirmed that an obstruction remains in
water monitoring well MW-NW. Notice of Violation CV2013-002 was issued as a result.
