Any material submitted under the previous application <br />(M- 2008 -052) is for background information only. Since the reclamation design <br />submitted is for Rangeland Post Mining as the final end use the relocation of the <br />Excelsior Ditch and related designs would be done with an amendment <br />application if the post mining land use changes. <br />12. Water pipelines: <br />a. What is the purpose of the proposed buried water delivery pipelines? How do the <br />support the post mine land use for rangeland or developed water resource? <br />b. If the pipelines are integral to the reclamation plan, is there engineering and <br />construction oversight identified to ensure the proposed use is achieved? <br />c. Please show approximate locations of the proposed water delivery pipelines on <br />Exhibit C and/or Exhibit F as appropriate. <br />Response: <br />The applicant/operator would like to clarify that this submitted application is for <br />a phased bonding approach and future changes to a different Post Mining land <br />use would be implemented through the Division of Reclamation, Mining and <br />Safety's amendment process, rather than technical revisions . This application is a <br />standalone application . Any material submitted under the previous application <br />(M- 2008 -052) is for background information only. Since the reclamation design <br />submitted is for Rangeland Post Mining as the final end use the purpose of the <br />proposed buried water delivery pipelines is not germane to this stand alone <br />application. <br />13. Section (c). Water Diversions and Impoundments — Assuming the Applicant <br />intends the post mine land use to be a developed water resource, the proposed <br />impoundments are part of the permit and designs need to be included. Please submit <br />impoundment designs, including slurry wall locations /alignments and depths so a total <br />bond can be determined. <br />Response: <br />No Water Diversions or Impoundments will be done for this application which is for a <br />post mining land us of rangeland. Therefore the applicant would consider it unnecessary <br />to submit the above designs at this time. If the operator in the future intends to change <br />the post mining use to a Developed Water Resource an amendment DRMS to facilitate <br />and fulfill the MLRB/DRMS rules. <br />14. Section (d). This section along with the information presented in Exhibit L <br />suggests no more than 9.9 acres will be disturbed at one time. The bond required by the <br />Division will need to be sufficient to reclaim all of the area that may be disturbed at any <br />given time during Phase One (assuming a phased bonding approach). <br />a. Please commit to requesting an Acreage Release or Surety Reduction when the <br />disturbed area reaches 9.9 acres and prior to disturbing any additional area. This <br />will ensure the proposed "floating bond concept" will have adequate funds should <br />revocation and forfeiture become necessary. <br />
