Hello Mr. Kamper and Mr. McAnany - Thank you to Mr. Kamper for providing the attached document to DRMS
am also forwarding the document to Mr. McAnany, as well as to DRMS staff involved with this case.
The document was requested by DRMS, for transmittal to OSM, in response to an inquiry received from OSM
about the use of mine water on soil piles at the New Horizon Mine.
This document will be incorporated into the DRMS files, and will also be transmitted to OSM in response to their
request by copy here.

Attached please find a white paper written by Aaron DeJoia of Duraroot, LLC, discussing the issue pertaining to
pit water that the permit objectors have raised.
In addition to this paper, extensive evidence was presented at trial on this exact issue, and the trial court did not
find any resulting damage to the property or liability arising from the use of pit water in suppressing dust on mine
roads on the property.
Also, please note that I have not provided a copy of this to Chris McAnany, counsel for the objectors, but assume
that you will do so as part of the normal distribution. if not, let me know and I will provide him a copy.
