Pineda <br />Director <br />The Division received Twentymile Coal's (TC's) application for a permit renewal (RN -06) on <br />November 19, 2012. The application was determined to be complete on November 23, 2012. <br />No concerns have been received from other agencies regarding this proposed permit renewal as <br />of the date of this letter. The Colorado Division of Reclamation, Mining and Safety has <br />completed its adequacy review of the proposed permit renewal. Please respond to the following <br />comments or concerns as necessary: <br />1. Based on a review of the ownership and control section of the currently approved permit <br />application package for the Foidel Creek Mine, comparing the section with the current <br />information in the Applicant violator System (AVS), there is discrepancies that will need <br />to be addressed by Twentymile Coal. Please address the following discrepancies listed <br />below: <br />a. For Twentymile Coal, LLC the following people were listed on Directors <br />/Officers Report but not listed in AVS: Mary L Frontczak as Assistant Secretary <br />beginning on 12/10/2009. Chino Kim as Assistant Treasurer beginning on <br />12/10/2009. Mathew S Davis as Assistant Treasurer beginning on 12/10/2009. <br />Walter L Hawkins Jr. as Treasurer beginning on 12/10/2009. Walter J Scheller III <br />as President, beginning on 12/10/2009. The following people are listed on AVS <br />but not on the Directors /Officers Report: Darral G Heaton as Vice President <br />beginning on 09/10/2012. Douglas D Loucks as Assistant Treasurer beginning on <br />02/25/2011. Amy B Schwetz as Senior Vice President beginning on 09/10/2012. <br />James C Severn as Vice President beginning on 10/22/2010.
