The area of interest is located adjacent to Routt County Road 27 at the <br />intersection of RCR 27A and includes a portion of the new RCR 27 Round - About. The <br />existing land use classification will change from Livestock Grazing/Wildlife Habitat to an <br />alternative land use of Industrial /Commercial. Routt County now controls and owns a <br />portion of this area and through agreement between Routt County and the landowner, SCC <br />no longer has any leasehold or ownership control of the area. The change in land use <br />classification is needed to remove SCC from any responsibility or liability for plans or <br />activities conducted by Routt County or the landowner and allow SCC to obtain reclamation <br />bond release and ultimate removal of the area from the Yoast Mine permit area. <br />The area of interest is a 6.25 acre area in the Yoast permit area, along County Road (CR) 27 <br />(aka Turnout Area), that previously served as dragline deadhead route when a dragline was <br />"walked" from the Seneca II mining area to the Yoast mining area. This area was previously <br />reclaimed according to DRMS and landowner approvals (parking lot and livestock grazing) <br />and was subject to the bond release process. Routt County acquired control of this area in <br />order to construct a round -about to improve public traffic safety between vehicles traveling <br />north and south on CR 27. Within this 6.25 acre area, approximately 1.97 acres was acquired <br />by Routt County as right -of -way for the round -about constructed in 2012. The majority of <br />the remaining pen area west of the right -of -way served as disposal site for excess material <br />excavated during the construction of the round -about through an agreement between Routt <br />County and the landowner. The limited area remaining that is adjacent to the west boundary <br />of the permit has never been disturbed. Seneca Coal Company requests a land use change <br />from livestock grazing and wildlife habitat to industrial /commercial postmine land use and <br />requests that the 6.25 acre area be removed from the Yoast Mine pen area. <br />Seneca Coal Company • P.O.
