ASPHALT <br />SPECIALTIES CO. <br />10100 Dallas St. • Henderson, CO 80640 • (303) 289 -8555 • Fax: (303) 289 -7707 <br />January 16, 2013 <br />Mr. Eric Scott <br />Environmental Protection Specialist <br />Colorado Div. of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: Request for 6 Extension of Time to Address Adequacy Review Comments for <br />Amendment (AM -2), Turnpike Mining Resource, DRMS Permit No. M -2004 -009 <br />Dear Mr. Scott: <br />Per an internal discussion with our consultant Peter Wayland and per a discussion he had <br />with you last week regarding groundwater sampling issues with the referenced <br />amendment, I am officially requesting that Asphalt Specialties Co., Inc (ASCI), the <br />applicant for the referenced amendment, be granted another extension of time for both <br />ASCI and the DRMS to effectively address the continued groundwater sampling and <br />characterization issues with the burying of the shale portion of this amendment. As we do <br />not want to continue to ask for extensions for a decision date on this amendment, we are <br />requesting that we be granted an extension of approximately one month from the <br />previous requested decision date so that we will both have time to ensure that the <br />groundwater sampling issue is resolved. <br />We appreciate the direction you have given us with another possibility of leachate testing <br />to potentially preclude groundwater quality issues with the buried shale. We are looking <br />into this possibility in understanding the underlying reasoning and procedures and <br />contacting labs on their ability to do the testing, as well as looking at other parameters of <br />the groundwater situation in relation to the proposed buried shale at the site. I assume that <br />the end of this extension request period will be approximately February 22, 2013 based <br />on the end of the previous decision date of January 22, 2013. We would hope to have this <br />amendment approved prior to the February 22nd date. <br />Please contact me if there are any questions or concerns you may have with this request <br />and let me know that this is alright.
