OBSERVATIONS <br />PERMIT #: M- 1980 - 037 -HR <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: December 14, 2012 <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Wayne Brantley of Pioneer Sand Company, Inc. was also present during the inspection. The <br />Ingleside Quarry is located approximately 5 miles south of Livermore, CO in Larimer County. The site is <br />permitted for 86 acres with a maximum allowed disturbance of 21 acres at any given time. The post- mining <br />land use is rangeland. <br />The permit sign was posted at the site entrance and the permit boundary was clearly delineated by <br />monuments as required by Rule 3.1.12. The site was not being mined at the time of the inspection; no <br />personnel were present. The Operator typically conducts blasting several times a year; blasting is conducted <br />by Yenter Companies, Inc. Once the material is blasted it is crushed in a portable crusher and then sorted into <br />product stockpiles which are located on the east side of the quarry. The Operator is mining into the limestone <br />and sandstone beds which dip — 20 degrees to the east, mining is progressing to the east and then to the <br />south. The Operator has committed to maintaining a highwall that is no longer than 1,200 linear feet. The <br />Division reviewed a 2011 aerial photograph from the National Agriculture Imagery Program (NAIP). The NAIP <br />image shows that the existing highwall on the west side of the quarry is — 1,200 feet in length. Therefore, the <br />Operator should not mine any further to the south until reclamation is completed on the highwall. Alternately, <br />the Operator may revise the mining plan through a Technical Revision to allow for a longer highwall. In <br />addition, the Operator would need to post a increased financial warranty to account for the increased <br />disturbance. The highwall is approximately 45' from the quarry floor to the crest of the highwall. The top <br />portion of the highwall is near vertical and the bottom two - thirds are at the natural angle of repose of the <br />beds (^'20 degrees). The Operator has maintained a 50 ft. setback from the quarry and the top of the western <br />ridge in order to preserve the view shed of the residents to the west of the quarry operation. According to the <br />Operator, material has been sold from the stockpiles within the past month. During the inspection the Division <br />notified the Operator that if the site is inactive for 180 consecutive days or more, then the site would need to <br />be placed into Temporary Cessation pursuant to Rule 1.13.5. <br />As noted above, the product stockpiles are located on the east side of the quarry; the stockpile area <br />encompasses approximately 6.5 acres. The overall disturbance is just under the 21 acre limit. Therefore, the <br />quarry may not expand beyond its current extent until reclamation has been performed or until the Mining <br />Plan has been revised. The Operator has a small fuel tank near the site entrance; the tank is stored with <br />proper secondary containment. No spills or leaks were observed. Overall the site is very clean and is operated <br />in an orderly manner. <br />The Division currently holds a financial warranty in the amount of $60,200.00. The financial warranty was last <br />calculated in 2003 as part of the approval of Technical Revision No. 1. The Division will recalculate the financial <br />warranty amount as part of this inspection. Notice of any increase to the financial warranty amount will be <br />sent under separate cover. <br />This concluded the inspection. <br />Page 2 of 3 <br />
