Keffelew, Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety, Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: Cripple Creek & Victor Gold, Cresson Project, Permit No. M- 1980 -244 <br />CHS # 52311 <br />Dear Mr. Keffelew: <br />On June 2, 2008 we received a letter dated May 29, 2008 from Gary Goodrich of Cripple Creek <br />& Victor Gold Mining Company responding to some of the questions we addressed to you in our <br />letter dated May 7, 2008 regarding the captioned project. Our concerns with the proposed mining <br />project are with both direct and indirect effects to historic properties. <br />We are enclosing documentation from the National Register of Historic Places nomination for the <br />Cripple Creek National Landmark Historic District. This documentation is comprised of a black - <br />and -white map as well as a written legal description. The latter includes the statement, "The <br />boundary is established by points of elevation surrounding the town of Cripple Creek in order to <br />provide the discrete natural setting reminiscent of the historic environment." The site number for <br />the Cripple Creek National Historic Landmark District is 5TL.2. <br />As we started in our prior correspondence of May 7, 2008, we believe that the State Register Act <br />[Act] [CRS 24- 80.1 -101 et seq.] requires prior to state agency action agency consideration of <br />historic properties in consultation with the Colorado Historical Society. The Act provides that <br />properties listed on the National Register of Historic Places are automatically listed on the State <br />Register of Historic Properties. We believe that the proposed mining may take place within or <br />near a State Register - listed historic district resulting in an adverse effect directly or indirectly by <br />compromising the historic viewshed.
