OBSERVATIONS <br />PERMIT #: M- 1989 -010 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: December 14, 2012 <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Rob Kisner was present on behalf of Pete Lien and Sons, Inc. The Weaver Quarry is located 9 miles <br />north of Laporte, Colorado off of County Road 72. The permit area encompasses 77.1 acres and the Operator <br />is restricted to a maximum disturbance of 21.9 acres. The post- mining land use is rangeland. <br />The inspection was conducted as part of the Division's regular monitoring inspection. The Weaver Quarry was <br />placed into Temporary Cessation (TC) on January 29, 2009; the first five year term of TC will end on January <br />29, 2014. At the end of the first term of TC the Operator will need to resume mining or receive approval for a <br />second five year term of TC from the Mined Land Reclamation Board pursuant to Rule 1.13.8(2). The permit <br />sign was posted at the site entrance and the boundary of the affected area was clearly delineated with <br />monuments as required by Rule 3.1.12. <br />The Division confirmed that no additional disturbance has occurred since the site has entered into TC. The <br />existing disturbance consists of a small excavation adjacent to the access road; approximately 3 -5 cubic yards <br />of material are stockpiled next to the excavation. In addition, there is a small area south of the excavation <br />requiring seeding. The financial warranty amount of $97,500.00 is adequate to complete the remaining <br />reclamation of the site. <br />On February 21, 2002, the Division received a request for an acreage reduction and an associated financial <br />warranty reduction. On April 24, 2002, the Division approved the request for an acreage reduction. According <br />to the approval letter (copy enclosed), 11.9 acres of the permit area was determined to be reclaimed, but was <br />not released from the overall permit area. In addition, the financial warranty was not reduced to account for <br />the remaining disturbance. Therefore, the permit area of 77.1 remains unchanged and the Operator may still <br />disturb up to 21.9 acres of the permit area. The Operator may request a reduction of the financial warranty <br />pursuant to Rule 4.14. The request must be made in writing and must include an estimate of the actual cost to <br />reclaim the site based on what it would cost an independent contractor to complete reclamation. <br />This concluded the inspection. <br />Page 2 of 3 <br />
