Received: November 20, 2012. <br />1) The Facility agrees to have all closure activities completed no later than September 1, 2013. <br />Colorado Department <br />of Public Health <br />and Environment <br />Re: Approval with Conditions: Climax Mine Crusher Adit Vent Raise Asbestos Disposal Shaft Closure Plan <br />Climax Mine <br />Highway 91- Fremont Pass <br />SW/LAK/CLI 2.4 <br />The Colorado Department of Public Health and the Environment (the "Department ") Hazardous Materials and <br />Waste Management Division (the "Division ") has received the following document for the Climax Molybdenum <br />Mine (the "Facility) in Climax, Colorado located on Highway 91 at the Fremont Pass. <br />The Division thanks the Climax Molybdenum Company for the closure plan of the asbestos disposal shaft for the <br />Facility and conditionally approves this plan. The plan includes a 3 page technical memorandum dated November <br />15, 2012 prepared by TetraTech of Golden, CO titled "CAVR Asbestos Disposal Shaft — Closure Plan" and a 6 <br />page asbestos decontamination work plan dated November 15, 2012 prepared by Koch Environmental Health, <br />Inc. titled "Asbestos Decontamination Work Plan, Freeport McMoRan Climax Mine Shaft Climax Mine CAVR <br />Asbestos Disposal Shaft Closure ". These conditions include: <br />2) The Facility agrees to follow all regulatory requirements of the Air Quality Control Commission as per 5 <br />CCR 1001 -10, Regulation Number 8 (Control of hazardous Pollutants). <br />3) The Facility agrees to follow all regulatory requirements of the Hazardous Materials and Waste <br />Management Division as per 6 CCR 1007 -2, Part 1, Section 5 (Asbestos Waste Management). <br />
