Please be advised that if you are unable to satisfactorily address any
concerns identified in this review before the decision date, it will be your responsibility to request
an extension of the review period. If there are outstanding issues that have not been adequately
addressed prior to the end of the review period, and no extension has been requested, the Division
will deny this application.
1.6.2 General Applicant Procedures
1. The Division has received the return receipts of the Certified mailing to the Owners of Record of all
affected land surface within 200 feet of the boundary of the affected lands. It appears that `Matthew J.
Moudy and Christina A. Moudy', owners of a parcel of land on the southwest corner of the proposed
mine site, did not receive a copy of the notice pursuant to Rule 1.6.2(1)(e)(ii). The Applicant must
provide a copy of the notice to `Matthew J. Moudy and Christina A. Moudy' prior to office
consideration of the application. The original comment period ended on October 21, 2012. Therefore,
in order to allow the any landowners who did not receive a timely notice a chance to provide the
Division with comments, the comment period will be extended by a period of twenty calendar days
from the date the notice is mailed. Following the end of the public comment period, the Division will
issue its decision to either approve or deny the application.
As previously mentioned, if you are unable to provide satisfactory responses to any inadequacies prior to
January 8, 2013, it will be your responsibility to request an extension of time to allow for continued
review of this application. If there are still unresolved issues when the decision date arrives and no
extension has been requested, the application will be denied.
If you have any questions, please contact me at (303)866 -3567 x8116.
Si i cerely,
Michael A.
