Division of Reclamation, Mining, and Safety <br />1313 Sherman Street <br />Room 215 <br />Denver, Colorado 80203 <br />RE: Permit Revision No. 7 of New Horizon Permit Number C -81 -008 <br />This is a petition to the objection of Permit Revision Number 7. The Morgan property has <br />always been one of the nicer and most productive farms in this area. The Morgan farm has <br />always been historically irrigated and cropped and has been considered as prime farmland. <br />Permit Revision number 6 `Board Ordered" Western Fuels to return all of the Morgan property <br />to prime farmland standards. NRCS has unanimously stated that all of the Morgan property that <br />was mined was Prime Farmland. The Court has entered a Judgement against Western Fuels for <br />violations of the Rules and Regulations governing prime farmland and for Breach of the lease. <br />The Morgan property needs to be restored to the prime farmland standards that it had prior to <br />mining and reclaimed according to prime farmland rules and regulations. No portion of the <br />Morgan property should be allowed to be changed from the prime farmland determination that <br />has already been approved. Rules and regulations governing this are 2.04.12, a prime farmland <br />Investigation that had to be completed prior to mining 2.06 The National soils survey handbook <br />had to be used to make that determination and NRCS had to be contacted. 1.04 The Morgan <br />property was always historically irrigated and cropped, not pasturelands since 1987. 4.25 The <br />soils had to be segregated and protected until redistribution and were not. The operations for <br />prime farmland are very specific and these decisions had to all be agreed upon and approved <br />prior to any mining activities. The mining on the Morgan property is completed and final <br />backfilling is being done and to change their prime farmland determination for any portion of <br />that property after the fact is inappropriate and is being objected to.
