We are requesting an <br />informal hearing to be held here in Nucla Colorado. Pr -07 is illegal and violates every <br />rule and regulation available governing prime farmlands. Some of these people objecting <br />to what WFC is trying to do and the submittal to DRMS that should have never been <br />allowed are some of the largest ranchers in this area with 100's of thousands of acres <br />among them. Most of these people are people who have bought hay from me in very <br />large quantities or horse people in small quantities, but have been buying from the <br />Morgans way before the coal mine ever came here or before they ever leased Mr. <br />Morgans property. Some who signed this petition ran the fertilizer truck for Coop years <br />ago fertilizing all the alfalfa and corn fields on the Sunshine Corner,way before the mine <br />was here. Pr -06 has not even been appealed in court. How is a permit revision even <br />being allowed when the other permit revision that the mine is SOLELY operating on <br />hasnt even been heard nor has a PERMIT renewal been approved which we ALSO have <br />an objection to ? ?? The appeal of PR -06 addresses the issues that do not comply with the <br />prime farmland rules. Prime farmland has been determined over and over and that <br />determination cannot be changed AFTER they have mined the entire place, which they <br />are FINISHED with mining. I have already listed numerous violations and numerous <br />objections in prior letters It must be put back "AS Good AS or Better than it was" prior <br />to mining, the Equivalent "USES" or "HIGHER Uses" prior to mining, and to the <br />Quality, Depth, and Quantity of BARX 2E soils that it had prior to mining. 196,356 <br />cubic yards of prime soils were removed from this place and those soils are NOT <br />available to put back. This is documented in PR -06, it is documented in the permit in <br />2000 and it has been proven in the 1998 soil survey and in NRCS's letter . The National <br />Soil Survey Handbook REQUIRES that the soils be returned just as they were, on the <br />same property that they came from and the aggregated total acreage cannot be lessened. <br />On the second half of our property, they segregated approximately 700 thousand cubic <br />yards. They are trying to convince you that on the BETTER HALF of our property which <br />ALL of these RANCHERS will attest to was the BEST HALF that they didn't segregate <br />nor protect, nor keep more than 130,000 cubic yards, they gave them away. And it was a <br />SINGLE lift not a two lift. This in itself is a total violation of the rules and regulations <br />and has been backed by OSM and ignored. We also want to address the permit renewal at <br />this informal conference even though my attorney said we didn't, he didn't understand.. <br />We do and the legality of any these things that are happening. I have sent OSM a copy of <br />everything and will be sending hard copies and have those in the mail in the next few <br />days.
