January 2,2013 C-1981-012/New Elk Mine LDS <br /> suggested <br /> • Ditch D15 must be restored to convey water flowing from culvert C73,past the new pump-house,through <br /> culvert C74 and back into ditch D15 again.Level 1.The division recognizes that NECC may wish to <br /> redesign the surface water management structures in this area,but asserts that a short term fix is necessary. <br /> • Straw bales on the south bank of the Purgatoire River,located under the conveyor,north of the wash plant, <br /> have filled up with coal fines and are therefore inadequate to protect the river from disturbed area runoff. <br /> They must be restored.Level 3. <br /> • The berm at the east end of the SAE south of pond 7 was compromised and must be re-built. Level 3. <br /> GENERAL MINE PLAN COMPLANCE: <br /> The response to the mid-term permit review is pending.A number of inconsistencies will be addressed during this <br /> process. Some,but not all,are mentioned elsewhere in this report and the October report. <br /> Non-coal waste (i.e. trash)continues to be an issue around the site (see photos 16-20). Examples include,but are <br /> not limited to: <br /> • Scrap aluminum in D28 <br /> • Barrel in D23 <br /> • Section of conveyor belt at NE corner of reclaimed Development Coal Waste Pile <br /> • Abandoned power poles in vicinity of Pond 4 <br /> • Concrete and wood south of the highway <br /> • PVC pipes near Pond 6 <br /> • Abandoned riser near Pond 7 <br /> Currently there is no area identified for trash storage before disposal. Ron Thompson has stated previously that <br /> non-coal waste is currently collected in dumpsters and hauled off site. In any case,trash should not be allowed to <br /> accumulate around the site. Level 3. <br /> PROCESSING WASTE/COAL MINE WASTE PILES—Rule 4.10 and 4.11 <br /> Drainage Control; Surface Stabilization;Placement: <br /> The RDA appeared stable and well drained.No water was ponded on the refuse (see photo 21). <br /> SIGNS AND MARKERS—Rule 4.02: <br /> The mine ID signs had been updated to show the new phone number for the mine,but the address was out of date. <br /> All of the mine ID signs(two on the highway,plus those at the Jansen Loadout,Golden Eagle mine and Lorencito <br /> Canyon mine) should be updated with the new address.
